Hubbell seems to think today’s agencies are non partisan and business like. And unlike the 1935 agencies, today’s agencies are not. That is the difference. Trump is destroying the deep state, and those deep state agencies whose unelected minions are 98% hard left liberals. So it’s a good thing to have the Chief executive, in charge of federal agencies.
The Presidents actual job description from the constitution reads, ‘“(the executive ) shall take care the laws be faithfully be executed..”
And POTUS is to direct federal agencies on how to implement existing laws, administers the government to fulfill the mandates of the constitution. Since these agencies currently serve the democrat agenda they are protected by the democrats.
Conservatives are tired of the deep state funding wars, massive fraud like the USAID billions of fraud. The federal government is not intended to be a slush fund for the left. And those days of government sanctioned fraud are being numbered by this administration.

The supreams weigh in when there is a split between various district courts. SCOTUS need not expand with population. Except when the left is not winning.
